drumdrum - if you aren't declaring earnings from a release then there is no total to deduct your expenses from, therefore no tax return 
When someone decides to sue, it's always going to be a business decision. Therefore if there does not appear to be enough money being made from the questionably legal release, then nobody is going to go to the vast expense of suing.
There are many guys out who seldom declare/clear samples but are regularly advertised in famous music mags etc...doom, mad, dangermouse are 3 obvious ones.
