absolutely they do....or they pay one of these companies to identify and clear the sample.

True as far as the money part,but money is not the only thing you can sue for. Say I sampled one of your songs and somehow you caught wind of it. Thats were it starts ,the arist has to hear about it. Now you sue me .Okay I dont have any money yet,but now I dont even own the publishins to that song and I cant make any money off of it ever. Now you own the publishing so you promote it better than me,since you are more well know and someone wants to buy it from you. Now tell me how that benifited me. No I didnt get sued for money ,but I got sued for property and rights. Ok now I use your sample again, this time I ask you and you say no. Well then If I use it anyway,were are back to situation one again.

Majority of indie or small labels dont clear sample and it is pointless for the musician being sampled to sue. Probably cost more to take Alchemist to court and sue then whatever he'll get from ALC and all.

there is no statute for it here (in australia) so while a case could be answerable, it would be a long and arduous process to get a conviction. it's still illegal, but it basically pointless - stones don't bleed money, no matter how hard you squeeze em.

where as in the states there are now a great number of cases which lawyers can use as a prior benchmark to prove that royalties are owed. (i.e. this similar case went this way - this one should too)


people could get busted down under, but the cost outweighs the potential remuneration.

So here's the thing....just anotha' pointless point....the same reason that joe schmo gets his car swiped and he has no insurance...he feels in the long run he's better off paying for the repair instead of taking alice malice to small claims...alice malice works at McDonald's, so its not like she's pullin down major funds...so taking her to court is a waste of time...okay 'nuff metaphor......come on...if I'm going to put a mix tape out...what am I going to do? I'm going to use samples...hell I'm gonna use instrumentals too...as a matter of fact I'm going to sample the artist vocals as well and run it...unless your talking major money...nobody is really gonna f with it...may not like it if the wind blows far enough, but if it ain't worth it...it just ain't worth it. Variables on this one....not a one answer fits all....soooooo anyway this is my pointless.........
