Is it illegal

I saw a tons of forums and documents saying that if you want to sell a record that use samples you must cleared the samples.

However, if i used samples to make a record and I want the record to be distributed for free, do I still need to clear those samples?

it only matters if you are making a lot of money from it that is taxable income, otherwise they can't prove shit.

They'd have suits against 10 million+ Youtube producers if so

plus the sample must recognizable as the original song they cant just say hey its a sample it must be identifiable the the "listner" aka a judge
