its actually the labels and lawyers job. As a producer on a label u dont need to clear them urself the label does. At least thats what i heard.

What Tdot said isn't always true if your just selling the beat it's the artist/labels job to get the sample cleared so that the track can be on the album. Clearing the sample is not your responsibility you are though requried to let them know exactly where the sample came from.

If there IS as sample, you better hope it's NOT noticible!!! It techically IS the labels responsibility, BUT now a days labels will NOT even give you your first half unless they CAN clear the sample, AND your not getting ANY publishing so thats why most cats in the game now are using musicians to re-play things. Your going to have to do this to make MONEY. The ONLY time I ever really sell sampled beats is to Independent labels that are under 10,000 units. But then the payoff is ALOT less then a Major. So unless your selling to someone like Jay-Z, who has the BEST sample clearance team in the business. You'll be on the Independent label grind!!!

Who's resposibility it is to clear samples will be stated in the contract between
you and the record company. If you can't persuade them to clear the samples
for you then you need to contact a sample clearing agency. I wouldn't recommend tryin to "get away with it". It can cost you dearly.
