Unless the samples are cleared you will get busted for the samples, yes they do check.

Look at some of the records of other Artist's and you will find most commonly that records are copywritten individually versus as a comp - use your own discretion. I would rather pay 30X9 versus 30X1 and losing out on $$ from my own mistake. I suggest you contact them and find out how that works, then re-post so everyone will know.

Some yes and no's to your post....

but u can still copyright ur compilation of work that u did with that sample, even if its not cleared
NO

Anyone can clear a sample, not just a label. You would have to contact the publisher and request permission and/or pricing. They also will request a sample of how the sample will be used and then they will say YES or NO and the yes can accompany a Fee - sometimes small, sometimes large, sometimes not at all. Everyone realizes how popular sampling has become and they all want a piece.

Sometimes it will be free depending on how you sampled, if you "Diddy-ed" the sample expect to pay.

EXAMPLE: contact (live) but EXAMPLE - this is from FlyteTyme

In order to sample or re-record one
of our songs, you must first get clearance by contacting: Gwen Irby

P.O. Box# 92004
Los Angeles, CA 90009
Fax# 818.753.0906

Usually there is a submission and application phase and then they will let you know from there.

It's TAX deductible as a business expense anyway!

you can copyright your sample-based productions without clearing the samples. its only when you display that production to a public audience either on CD or live or any other form that brings you profit, that might get you into some trouble. this was the advice i recieved straight from my lawyer. ever make a collage in elementary school? did you clear your "samples"? same principle applies here. unless your getting paid, don't stress clearing samples. even in some cases where you do profit its still not a concern. say you sell a beat outright to someone (something i will never do) and make a couple bucks, at that point you no longer own it, its their production and their problem.

^^^^Dude is on point...

You can copy right a song with a sample in it without getting clearance but you have to notate what you used, how you used it and were you got it from on the form. I called a couple of months ago and talked to their help desk. The trouble comes if your work gets published without clearance.

I never said you couldn't, you heard what you wanted to hear. But do as you like, but of course you want your schit to blow - it wouldn't hurt to contact the publishing company. Worst case scenario, your beat gets picked up and because of exposure you can't clear it or they want stupid $$$ hence Dr. Dre & Dj Quik - Truth Hurts.....

Remember that it is not just the PUBLISHERS that you need to contact.. more importantly it is the MASTERS owners that need to be contacted. They own the actual physical recording. The publishers just own the copyright. Example.. say you sampled Led Zepplin, When the Levy Breaks.. You'd have to contact the owners of the composition (Masters) and also the Publishers of the work.
Now say you RECREATED when the Levy Breaks.. Now you just need to contact the Publishers and clear via them and forget about the Masters owners becuase you just created your own Version (your own masters)

Me personally I'm not trying to become famous, I'm not trying to blow up, I just want to make good music and have it not be jacked. So what I'm hearing is I can copyright the beats without clearing the sample? I can list what I sampled and everything and not worry about them not clearing it? If so... 8)
