Indie Film Soundtrack

Just got a hit from a dude who does indie films/documentaries. He sent me an agreement, which i dont quite understand. i dont want to give up my rights. i pasted the agreement below. Who would be the publisher? help is needed asap! Thx

This letter serves to confirm “______” have granted Joe Inc/Sex Films permission to include the song entitled “Saturday”or any excerpts thereof (the “composition”) and the master recording embodying the performance of the composition by the artist known as “J Wales“ (the “master”) in connection with the Video production tentatively entitled “Prostitute From Paradise “ (the “project”). This permission includes all rights to synchronization and master recording rights.

The licensor has agreed to grant the above mentioned non-exclusive irrevocable rights and license the composition/master for perpetuity that includes advertising, marketing and promotion for the above mentioned “project” in connection with “Prostitute From Paradise” and all versions of the “project” in all media. In For said amount of $200.00

well from what i can tell your selling them the masters and the rights outright.
they have the publishing rights and syncro rights from what im getting from it.

Know any lawyers? if your going to be getting into this profession you need one. it takes them 2 mins to read over this and tell you whats up so its not costing you a ton that way.

And this is for a porn film isnt it?? hahahaha

I do score for porns all the time, i just read the "script" and talk to the director and producer to find out what they are looking for and write something for that, then send it to their post guy. That way im not watching that nasty shit all the time. But i probably would make more if i did it all, score and sound edits.

if it's a sample-based beat i would recommend inserting a clause in the agreement stating that it is their sole-responsibility to clear any and all samples if legally required...

no doubt, i wont be using any samples. but when i read the document again i saw my favorite word non exclusive. i think i need a lawyer.

Price is low - way low. For that, if you're determined to do it, have your lawer do up a contract (or find verbage on the web) that grants a one-time use of the piece for that specif movie only. You can give them an exclusive on the tune, but as written, if the movie hits and your song goes on to be a hit it's still only $200.....You want to make sure you get credit for authorship and preformance too.......
