I'd love to see someone actually sit in court, with a proper suit on and sh*t (maybe wearing an old, rugged Akai t-shirt from the 90s under his jacket), all weepy, moaning how Akai did not release the X as soon as they promised…
Jury'd try to take it all seriously, trying not to laugh (probably tapping some ill beats on the Live under the desk), etc etc.

Well, the suing part is not going to happen. No serious attorney is going to take that case.

If you got a discount l say keep it unless you need the money for bills etc.

If you can't put up with the wait you have the right to cancel.

Never fails as soon as you cancel it will drop.

First of all, thx for the great replies especially the portrait from Andy, laughed my ass off but I want to reply to Jpeg and especially Richie off course without using his mongoloid F-word since that is ALWAYS a sign of weakness. But I'll try reason maybe he gets a little tiny bit smarter then.
You ask:

First of all a contract can be orally made to and we got many many false proofs of release dates but maybe you didn't notice.
I want you to imagine building your own house, I know that can be difficult for you but try. And 7 months ago you ordered a whole roof to make it easy. At least a 1000 companies make roofs but one shows you a prototype of a fantastic roof with everything you want on it AND it promisses many many times, recorded and stated everywhere to deliver the roof within 30 days. And furthermore if you buy the roof directly in one of its shops you get a big discount.
Would you be sitting in the rain with your family after half a year of waiting or after this time give up one your discount and start alllll over again? No you wait and wait and wait cause new promisses everytime ask you for just a month ....

You then asked:
what money did u give akai and how did they use ur money to make promises?
The freaking money the unit costs off course...... Real intelligent remark. I didn't give it to sharity this time.

I wanna help you see a law suit won't make a day of light.

Akai will have a team of lawyers also. You can cancel your order any time.

No attorney will take your case based on your conditons. Try to lawyer up.

Did you pre-order direct from Akai then? Or did you preorder from a store? When you order from a store, your contract is with the retailer. It is the retailers who are making the concrete shipping date claims. Akai are not that daft, they've just been talking in vagaries and estimates.

If you want to sue someone, it is the retailer you pre-ordered from that you should be suing. However you should check the terms and conditions of that pre-order, I'm sure you read those real close before buying. Given the fact that you can cancel pre-orders at any time at no cost to you, I fail to see on what grounds you have to launch a lawsuit.

'Buyer beware' - you should do your due diligence before dropping a couple of grand on vapourware from a company with a very checkered history like Akai. We all warned you guys that all these 'release dates' were very likely nonsense and to just wait until the units were released and the reviews in. We also warned you that these things would most likely be running half finished software, and so far that's exactly what's happened with the Live. It's all very predictable.

What's crazy for me here is that in order for somebody to actually even consider suing somebody for something, one has to be pretty hurt, offended, or they must've suffered some losses or something caused by the party they'd consider suing.
Or you might think they've invested a great amount of money in something – without the chance of ever getting it back by any other means.

We're talking about a musical device. It's probably not like your future, your income or whatever it might be depends on it. You do have some other means to make music, don't you.

I'm not even talking from experience, but you probably understand a lawsuit is no small feat or a walk in the park. Also, to do that, you must have a hunch that you can actually win the case. Unless you're really stupid.

If you really don't have any other means to make music, heck, get a free DAW from the net and get crackin' and forget you ever tried to deal with a company that hurt you so bad it almost made you enter the court.

Hell, if somebody's still that pissed off about Akai/X, I just don't get it whey they don't just pull their preorder and move on. Nothing's stopping you.

But if you ever get into court with Akai, please do film it and post it here for the sake of entertainment :)

As someone who has spent enough time with lawyers and in the courtroom over business dealings, I can say this is an idea that's probably comforting (sort of) to the OP, but will never see the light of day. Sorry, but your reasoning above isn't even close to being something an experienced lawyer would touch. A few extra points:

1. Akai's hand was forced (to announce) by the FCC when the application was revealed on their (FCC's) website. As I understand it, their original intention was not to announce until this coming fall.

2. All new product release dates are subject to change, no matter what the end user wants or what's stated by a representative online or in person (see below).

3. We have no idea what sort of manufacturing delays, mistakes, re-builds Akai is experiencing, nor are they required to release that information.

4a. Please determine if your sales contract is with Akai itself or a retailer. If Akai, see above. If a retailer, see above.

4b. If a "contract" exists with a retailer, you must give them ample allowance to make good, including offering you a refund, alternate product or you will simply have to wait until the above conditions are met.

Best of luck to everyone who's upset with Akai. I'm truly sorry you don't have your X or your Live. I do hope you get one in the future, as you might enjoy it (I say might, as you - YOU - have poisoned the well). You may well wish to look at other products that cover roughly the same ground as the new MPC models.

BTW: Before you besmirch my online reputation, please be aware that every legal proceeding I've ever been involved with was due to non-payment by clients and not due to actions by my company, our agents, nor myself. You'd be surprised at how people try to get out of paying their bills ... or maybe you wouldn't ...

A plaintiff who is sold less than what was promised by a product label has a right to recover the amount by which is overpaid

Energy drinks company Red Bull was sued in 2014 for its slogan "Red Bull gives you wings." The company settled the class action case by agreeing to pay out a maximum of $13 million - including $10 to every US consumer who had bough the drink since 2002. Who would of thought they win that?? :smoker: not this form hahaha

This it the wrong group to motivate for change. Too many riding the fence and Inside Man working for Akai... :popcorn:

:nod: :nod: :nod: Well said! This sums up why I'm waiting on purchasing the Live. I'll just use my 'old STABLE & RELIABLE aircraft carrier' with Studio One for now. :-D

The Op doesn't have the X in his possession. I worked in Law for over 12 years and l have nothing to do with Akai personally. There's a thing called EVIDENCE that he needs.

What contract does he actually have with Akai? Funny thing is he's asking for a worldwide gathering lol

I don't even feel like going into the lenghty litigation process over this. This is nothing more than a rant nothing more.

When l seen that Propellerheads didn't support offline computers no more l ranted on youtube and got an answer how to actually load my 1,000 presets to my offline computer. Trying to sue Props was furthest from my mind.

I wanted the X but did l need it? No so l went for the Live and l have one. :-). Pete Goodliffe and Andy with others kept giving crazy hints when it would drop. It didn't drop and l got angry. Then l told myself "hell are you angry for you haven't preordered that item, sit your arse down and be patient". That's what l did you didn't hear a peep out of me. Then next thing l know the Lives dropped. ILL Green and Eyaic let me know MF had some to buy, l hit that phone and got mines. So its a mtter of patience with the Op.

An intellectual rant can work if its done right.

This guy has two options.
1. Cancel his order
2. Or wait!

It's not fraud; it's just misleading. None of these sites ever told you they had the item in stock. They are "expected" dates, upon which you based your order. I'm sure if you read the full Terms of Service at any retailer, they will have a clause that protects them from claims like this. If you paid full price on pre-order, you got f*cked by the retailer. So go get your money back from them. The fact that they will certainly give it back to you in full completely destroys any "case" you have. Also, there's no business in the world that would just give you something for free because they missed an expected date. A discount? maybe, if they value your business. Just cancel your order. I did when I got annoyed about the Live's dates, and I'm still happy I did. Got a bunch of other gear instead.
