I'm not going to go into prices, make money. Sure people may think it's worth more, but they aren't buying it. But, tell the artist that it is there responsibility to clear the sample. While that person can be making money off shows, albums sales, etc, you are just sitting on that $40. Plus, i assume you arn't dealing with royalties, and even if you were, i don't see them comming for that price. It is very common when selling beats to state that it is the artists responsibility to clear all samples. Obviously it's your resposibility to tell them who you sampled, hopefully after you get paid.
