what if i sample an old song like The Supremes or The O' Jays.and sampled some volcas and some of the instruments...and i try to sell it.do i have to pay the artists???or who do i have to pay? :? :?:

no you dont. but if you havnt cleared it before you sell it, and the song happens to be top 10 on the billboard, the ppl who own the rights to the song, might want to cash in on the situation.

lol okay maybe i wont sell any sampled beats.but what if i have sampled the beat and i rap on it and put it on myspace...thats okay right???

yea, like basically you shouldnt worry about any of it right now. im assuming you are not signed to any major label or anything like that. so if i was you i wouldnt worry about it. you can sample and sell. but once theres alot of money being involved thats when u might want to start worrying about all that. for now you can just chill

legally you can be sued for using any uncleared sample. It is not ok to use samples without permission. However it is very unlikely that you will be sued if you stay under the radar.

its the artist/labels job to get the sample cleared. Your job is to know where you got the sample from.

right...i'll know who i get from and i will provide the contact to the publisher to make it eaiser(say that i did in the contract too).

yet the law still states that you are technically supposed to clear it before u sample it. most dont/wont and i agree its a waste of money to clear samples that might be unuseable but knowing the law is important. ive seen a lot of wide spread non truths in this thread. this statement is usually how things are done but legally it isnt technically correct

okay....i'll get it cleared :?...but i thought most of sampled music,you have to pay them when the record (or song) sells.and what if i just sell my beats just to "signed" artists not unsigned.

but what if i were on a label (as a producer) then do they have to pay for the sample????

I would just get it cleared when somebodys ready to buy the track.Before that I don't see a reason.

you are over complicating it. simply put the legal way of doing things is to clear everything period. the logical way is to clear it before u release the album. however a lot of people dont worry about clearing anything until they have major attention (10k units or more). I suggest you read up on US Copyrights. It may save your butt one day

as a producer i personally wouldnt clear it or even look into it until I am ready to release an album I just think this guy should understand that legally putting sampled music on something like Myspace can get you sued. However it is very unlikely
