Is Sampling drums from a recent Hip hop record to make hip hop music biting?

I don't see how they could prove it beyond reasonable doubt in a court - especially if it had had all those effects applied. Very interesting.

Someone once told me that with sampling laws it depends on the length of time of the sample - I was told if it's under 3.2 seconds or something then it's cool - not sure how true that is.

I remember hearing something else about it being related to what percentage of the original composition it is - i.e. if it is under 5% (or something like that) of the original composition then you have not taken a significant percentage of the composition (or maybe it was what percentage of your composition the sample forms ?)

Either way I don't see how just one snare can be ruled as being significant enough.

interesting - is anyone out there a legal expert or something who is up to date with the laws ? I think even in the legal system it's probably a bit of a grey area at the moment too ?

I heard it on a forum I'm on that doesn't have anything to do with sampling, so no one has a reason to fake it.

Well, judges rarely know much about art or music, so if they show it is the source, and the man didn't clear the recording, then he's ****. It can be a millisecond, but if they can prove it came from a source, then it is breaking the law. There is no 3 second rule. But they only go after you if you are big time, small time cats are either under the radar or not worth chasing. Sampling one snare is pretty much against the law if it is from copyrighted material. It is sampling CD's that keep samplers legal!!

If you read that beastie boys lawsuit thing, you'll see that they cleared the recording, but not the composition, the beasties won because 3 notes doesn't constitute a composition, but 3 notes, or even 1 snare from a recording not licensed from the owner is very much actionable. The question is, is it worth it for the copyright holder?

it sure is bad news, since the law is pretty clear on that, hopefully there will be a change in it to allow sampling, but I doubt it.

I suspect he was quoted somewhere saying what he sampled, but like I said, I can't find any more info on it, anyone know where to get that kind of legal news?

i had to get on and break the tie to 50/49 in support of ethics... im not really gonna get to technical with it but the kids just dont have any respect, im 22, pretty young but i have respect for this hip hop beat game and i just gotta respect myself and the gods who ruled b4 diddy popped up with his hits from the 80s that sound so crazy and made the game to what it is now, no fukin ethics, these youngns just dont know what quality hip hop is no more... sorry if i hopped in late but i was away on business. lol :lol:

I got a feeling there are som shenanigens going on with the poll, 100 people voting, that sounds wrong. And whenever the ethics got the lead, it would suddenly tie up.

I gotta confess - I posted my opiion but i never cast my vote - so I just did it then - but something weird happened - I voted yes (i.e. it is biting) but I swear it registered my vote in the other column, that is the no votes got another percentage in their favour. What's up with that ?

I'm 18 (Young by most people's standards)... And I'm the same way man... People need to respect the fact that if you're gonna sample you shouldn't be rippin off your selders to do it.... You gotta get your vinyl weight up and step your game up and create your own sound...

This seems to be a dying art anymore... Everyone just wants the easy way out when it comes to digging...
