Is Sampling Off An Old Vinyl Legal?

Real Basic Question... Anyways I Herd It Is Actually Copyright Infringment And Some Next Bullshit Even If You Sample Like One Note Off An Old Vinyl Or Watever

And Why Dont Like Every Single Beatmaker Get Sued In The Industry Since Almost Everything Is Sampled Off Something Else (Unless Composed Or Whatever)

You have to pay copy right for every sample you make of copyrighted material no matter what the origin is (vinyl, cd,dvd,....) A lot of artist clear the samples by paying a fee to the copyrightowners of the original material. Another part don't pay anything and hope that noone (especially the copyright owners) will notice the samples. Or they reason/hope that the number of copies sold is too low for any copyright owners to make enough money if they were to sue them.

Yes, if the copyright still exists it is illegal. Even if you sample a single note and not a whole melody, the recording itself is copyrighted so it doesn't matter how long the sample is. Most if not all of the samples used in mainstream music have been cleared, even if it doesn't say so in the liner notes.


But there are many reasons why producers who use samples aren't sued:

-The sample is unrecognisable (filtering, reverse, eq, all kinds of effects..)
-The sample is so rare that no one has identified it yet.
-The artist who samples isn't selling enough records (making enough money) for it to be worthwhile for the copyright owner to sue him
-The owner of the copyright might like what the sampling artist has done and has given him permission to use the sample without cost.

feel free to sample whatever you like, if MF Doom can get away with sampling the beatles then the chances of them coming after you is slim to none. If you don't blow up, that is.

another way to get around sample clearances...

sampling records is illegal unless u have a clearance for it, or unless u can prove u tried to get a clearance.

if u want to LEGALLY sample something find out the artist ur trying to sample, find out who there publisher is with, then send a DOCUMENTED letter to the publisher asking for a sample clearance... chances are, unless they know who u are they wont even open the letter, which forfeits their right to legal action against u for using the sample. The key to this is DOCUMENTING everything it will only work if you can prove you tried to contact the company to get the clearances.

if i use sounds from a 909 or and 808 on my mpc, can roland sue me?

yes, this is really a fact, it floored me as well. i dont know if it works everywhere in the world, seems like something only US can get away with.

dont worry about it SAMPLE ya hearts out! just remember that its better to sample the raw esscence of the song rather than re-jiggin it. be creative and cut it up make something new out of it so that u can say u made it.

on the other hand with regards to MF DOOM.......... Dont be like him... he wastes great breaks... if I had then breaks he had BOY!! it would be a deep ting, anyway thats my opinion.

Amon Tobin on Ninja Tune does sample a lot without paying anything to the owner of the original sample..

nice call on Amon Tobin, Ikke, that guy is my hero, the song slowly is just one of the greatest work of any samplist I've ever heard..
