You seem to be pretty knowledgable about music biz... my question, if you can help....

Is there any money for the sample based producer?? I mean can a new producer make money of songs he put together with samples? How would i go about copywriting or publishing on sample music. or how would i protect the song while shopping the beat??

Ok I got some time now...

There IS money in sample based production. Little do you know, MOST of the songs you hear (even Neptunes) use or re-play samples. Now mind you if you re-play something is definitely BETTER on the money tip. I now use musicians for things I can't play myself and thats the next step for most producers. You start out just sampling but when you start making alittle money you'll pay someone to play some melodies and sample clips from that. That way you won't have to deal with the companies that own the publishing on the track you sample or the artist (as long as it isn't the same exact melody).

Copyrighting and Publishing:

You can't publish something thats NOT yours (sorry). Now you can copyright the arrangement (the way you sequence the sample). NOTHING CAN BE PROTECTED if it's a sample. And don't be fooled the industry have what they call musicologists (people who examine songs for possible sample use). And just because you CHOP, REORDER, FLIP, BOUNCE, FILTER or any other thing you do it can STILL be got. Thats what THEY (musicologists) do, thats why you have these sample books. Also you'll need to stop supporting those books if sampling is your thing. Because your not doing anything but hurting yourself. NEVER tell were you got a sample (unless a label asks you). AND DO NOT LIE!!!

haha. okey doke dude. Like this hasent been common knowledge to sample spotters. like they dont check out www.the-breaks.com (which most of these books are based off of) and is updated daily - instead of a 2 year old book. I know alot of cats have beefs with that, but look at the dusty finger comps, and the like. They blatenly say sampled by so and so etc... U have to pay to play. I think its good in some regards, casue the people that u are jacking loops off of get compensated like they should be (sorry u have to pay cats, but hey they put hard work in to make the music that you are stealing, so i think they deserve a check and the credit). And about 90% of the dudes in that book have cleared there samples if they messing with majors. Alot of labels dont want to take the risk of putting out uncleared joints so they dont suffer repercusions like biz and dre for ex. I use all samples in my work, but if i ever get signed to a major, i will clear my joints out of respect, and the ones that cant be cleared will be released as bootlegs. Im not really motivated by money so whatever.

In MANY copyright infrigement cases in Hiphop the lawsuits are over SOUNDS, not melodies at all, meaning (you sampled Roy Ayers synth sound) not even the melody, the sound. And play something totally different and you get sued thats WACK!!! (reference http://copyrightcriminals.com/ DJ Q Berts section). Because you use a sound, not the melody which I do. I hardly EVER use loops unless it's crazy on it's on. I don't think you should pay. And like they said EVERY over artistic craft has SAMPLING. And those people aren't being sued? Please not to bring up on race BUT Hiphop is and was a voice of the minority. And most of the samples I've had to clear the artist didn't want a dime!!! It was the label or publishing house that was greedy, NOT the person that actually played the material.
