How big a deal is the release? I would venture that if you
don't forsee (honestly) the thing selling over 20,000 units,
then there is no harm done.
I actually released something where I used a
sample from a very popular movie.
Although the sample wasn't the very recognizeable
'spy themesong' we all know, I got pissed...
The producer told me way after where it actually came from,
but we all know it was a sample to begin with.
The long/short of that is, we got away with it, cus
even tho it did decent in US and
elswhere, the sales weren't anything that would
get the attention of people who made the flick.
If you are selling the track, however, be it
a major or independant release, I would make
sure that the contract states the final owner of the
master recording is liable for sample use, not
yourself as producer.
