When do you NEED to credit a sample?

I gotta question.
When sampling, when exactly do you cross over to the point of giving credit to a sample.

What I mean is, it's perfectly fine to sample individual drums sounds (kicks snares hi hats).
But what if the kick or snare has a piece of a bass line or a piano or whatever?
And what about taking chopped up bits of a certain instrument (piano, etc.).

Of course if you're taking an entire looped sample (whether its drums or anything else) then it needs to be noted.

But yeah, basically, when do cross the line for needing to credit a sample?

if you sample you always have to credit and clear the sample no mather how small it is, but if it's so short that you could not be able to tell the source then just don't, let them try to sue you... they won't have a easy job doing so...

if ur selling less than 5000 then don't bother, I never have once and I've released over 40 records, all of which contain samples. If it goes big then your record company can deal with it.
