I'm going to release my new album nationally over here in Norway this fall. Should I bother going through sample clearance? I think I'm looking at pressing 1000-1500 copies. I have a lot of very obvious samples, but nothing that most people will have heard. On one track however, I sample a vocal loop of a track that was a hit in the UK back in the 70s.

Should I clear all tracks, just the "famous" ones or not bother at all?

as soon as your album starts making money or you have a hit song your going to wish you cleared your samples. Sometimes its cheaper to clear samples before a song actually makes money. If it makes alot of money someone is going to one a cut of the money usually more then you will be happy to part with. Good luck

1500 copies won't generate enough money for anyone to sue you for. Now if you sell a couple hundred thousand copies, then the original artist may want a piece of the action. The cost of hiring a lawer to set up a case would exceed the total amount of cash that you made from selling your cd's.

use a couple of famous samples and use alot of un heard of ones as well ... the reason is so you can give it a mix up and most ppl wont no of the unheard samples so they wont sue you.... and a lawer can be a bit** to pay... if i had 2 pay him a nice load of money would murder that dude....might as well instead of being stuck with a bit bill!..... and like the member roxstar said thats not enough copys for anyone 2 sue u .... some famous artist might want a big cut at it but work it out if it happens.....holla back

Well lets see....we start with stealing other musicians copyrighted material, and end with shooting lawyers (not too bad an idea really, but totally impractical - too many lawyers, not enough bullets) so what's wrong with it is practically everything. Say dude actually hits with uncleared samples - he's in a world of trouble because he's in the wrong legally. Second, while some folks can steal and sleep OK, as you grow, you might just start feelin bad about it. In other words, its wrong morally. Third, support the theft of samples, and when you finally hit and someone steals your ish, you're gonna feel differently. Now I'm sure the answer is to shoot the cat who stole your stuff, but he might shoot first or you might get caught. It's hard to spend your millions in the joint or planted. Fourth, when you do hit, the tax man cometh.....so now you owe taxes on money you don't have because you spent it all on lawers and you're probably gonna lose the case to boot.....Now if you can overcome both the moral and legal issues you're in the wrong business - you should be a preacher :wink:

Man fader dont know wat he talking about.....dont clear dat ish or its gon cost you way over ur budget (pressing, promo, mastering/studio time, graphics and clearance) and no1 wants money from a guy doin mixtape numbers coz its gonna cost them more legal fees in the long run. Save dat ish for a major label or big project.....1000 copys falls under promotional use its not like hez gonna enjoy radio play all day, BET, MTV, VH1 or get on the bill board chats I mean he eint even goin gold or atleast a 100 000 copies.....think man. My beats get used on mixtapes all the time and i'm not bitching.

Mixtapes and releasing an album is two different things.
Ask the "Drama King" Kay Slay about the mixtape game.
Now, being that this sampling issue is becoming of increasing concern, check the following piece of info...
expectations were high for Biz's next album, I Need a Haircut. "Sales were already disappointing" when Biz was served a lawsuit by Gilbert O'Sullivan, who claimed that the album's "Alone Again" featured an unauthorized sample from his hit "Alone Again (Naturally)." O'Sullivan's claim was upheld in a ruling, Grand Upright Music, Ltd. v. Warner Brothers Records, Inc., that altered the landscape of hip-hop, finding that all samples must be cleared with the original artist before being used. In accordance with the ruling, Warner Bros., the parent company of Cold Chillin', had to pull I Need a Haircut from circulation, and all companies had to clear samples with the samples' creators before releasing the records. This development mirrored the increasing popularity of hip-hop and the financial stakes over which releases were set. Biz responded in 1993 with the mischievously titled "All Samples Cleared!", but his career had been hurt by the publicity emanating from the lawsuit, and the record suffered accordingly.


You don't expect to sell but "X" amount on the first album, okay fine.
But if it catches on or you go on to do a second, third joint and blow up, then people start checking for your first joint, and you exceed those first numbers, then what????

Releasing an album with well known samples can be costly given the right circumstances.

Yo i was thinking about the same ish for awhile now. I got like 2 or 3 full length lps ready w/lyrics cutz and all. But i don't know how to go about the ish i've sampled to make the instrumentals on these albums. Do i get sample clearance 1st,release it white label underground, chop em up to where it is not as noticable or what? I'm really in need of everybodys help man. How does people like MFdoom and Pete rock do it where no one ever finds out or busts em?I mean i know they get the unheard samples and all but what about the more noticable samples. i.e.-THE METERS or SANTANA, RICK JAMES,FUNKADELIC,MILES DAVIS . How do you go about doing this without all the drama?
