this is a problem because the track is only recognized as "unused" in pad mute.

I can produce this...but do you care to share why this is a 'serious' bug?

Anytime you name a track or set the type, mute, MIDI, or program...an empty track changes to a used track, even if you have not recorded anything.

So although going directly to and recording into grid edit mode will show a given track still as an UNUSED track..any number of the functions above (which for the most part, are done prior to recording) will solve this 'problem'.
