Who pays for Samples

When an producer samples a record. Who pays for the sample. The Artist, Label, or Producer. I was curious. Is it true when a producer sample a record they get more money. Since the record is sampled.

Most producers leave it up to the Artist/Company who buys the beat. Do a search on this cause this has been discussed enough to get an understanding of how it works.

Also when an producer samples an beat I dont really think they get more inless its like some crazy heat but the person who has the rights to the song they sampled from gets paid also.

Labels ALWAYS pay.

It is cheaper for a producer or beat maker to pay for the sample b4 hand because u can get a better deal with points/percentages on ur royalties and publishing but if u dont wanna deal with the process of clearing a sample and paper work you can leave it to the artist and label but it will bite u in the ass and cost u in the end. If u leave it to the artist they are gonna give up ur points to the owner of the recording instead of theirs if the owner of the recording was 2 demand more points and u would end up with no publishing.

Wen u produce a song u get 50 percent of the top, then u split the other 50 percent with the artist so technically u get 75% and the artist gets 25 percent of the song. So if this was an original composion u are good.

Now lets say u sampled and let the artist take care of the clearance....The owner of the recording sampled or label dat owns the recording would want a percentage to so the artist would give em a percentage of ur publishing, and some times they take 100% of the production which is ur 75 percent and u walk away with nothing on the back end/publishing. The only thing u get is and up from fee of anything from $5000+ depending on the artists status and label/budget. U also get production credits and dats dat.

So I hope u see how clearing ur own shit would help u out in the long run.

what if you're not on a label or anything...and you're just starting out new do you "the producer" have to pay.....anyone???

if you are not pushing major units i wouldnt worry cause court fees alone will make it pointless to pursue. once you start moving weight, hopefully you would have bought only one escalade, you will have some $$ bargaining power; like you could offer to put the artist on the record or some bs like that which will help jumpstart their career again. it so many ways but i wouldnt worry just yet.

I have a policy.... If I buy a record .... I've bought a whole record full off sounds , how I use the sounds is nobody's concern but my own...hence I payd for the record.... so I pay my recordstorekeeper a small fee wich helps the music industry... and I go on sampling.....

I'm not expert by any means, but from what I've read you actually have less bargaining power when the benjamins are rolling in because you now have something to lose. My guess is that the owners of the rights are going to be much easier to deal if you ask them first.

In the end the only ppl who pay for a sample is the writers of the new composition......and don't sample a song that has a sample in it (100 miles and running) cuz not only are you paying Mc Ren, Dr. Dre, and Eazy E.....you are also paying George Clinton, Bernie Worell...........etc......but hey don't let that scare you...sample your pockets out.......
