? on Sample clearance

Yo, after you find your samples and track your beat do you get clearance for your samples OR do shop your beats 1st.

chop em first! chop em enough and you wont have to clear em if no one recognizes them

Or you could just hire Suge Knight to go after all the people that try to collect royalties on their samples.

After you sold the beat.The label/artist/publisher will have to take care of that.Or you will have to take care of it and they will have to pay it.

I respect the artists that i sample, but im not moving them units to be on the radar of people lookin out to get royalties.So i dont really care about that.

Thats tha Grimme UnderGround HipHop way and I plan on doin that but in this business you need to know both sides of the coin. I don't want to sell a track and not have clearance and get sued, then in turn lose my clientell because I didn't handle my BI, Ya Know!

OK, say if I'm sellin my tracks to MC JoShmo off the street is it my responsability to tell him what samples are in the beat so that they can be cleared or would that just be common courtesy?

I dont think you have to tell the mc. It also depends on how big the song gets. If you release it with a more underground approach rather than mainstream, there is less a chance the wrong person might hear it. Unless it completely blows up.

i know that dj kno from cunninlynguists doesnt clear any samples. at least on the first album he didnt anyway.

that should be worked out in your contract and the rights that you give the beat up under.

that would waste a lot of dough.

i know an engineer/producer whos signed to an underground label and i asked him about it. he said if hes pressing under 50k copies, he aint clearing shit. to each his own.

also remember that getting sued is publicity. could be manipulated into a good thing.

whoever owns the rights to the track is the one who would get sued, if you make a beat and sell full ownership of it, you won't get sued. Ex. DJ Quik made the truth hurts beat but dre owns it so dre is getting sued.

Ok ok Ok ok, Ive got some clearity on the situation. If I relinquish all rights to the track I wipe my hands clean, if I'm doin beat CDs don't worry about rights unless I continue to be involed with the project and my resposability toward each track will be on the contract in ink. Let me know if I still sound confused.
