Rules of sampling?

He's right guys, the rules has changed again. Before you was free to sample one bar of a song, now they want you to pay for the entire song even if you sampled a single snare. Its political bullsh*t but I'm still sampling for art of making beats and not for business. There are companies that if you bring them a sample off a record, they can remake it for you for a flat rate with vinyl crackle and all.

The law emphatically says, "get a license or do not sample". That's it, and it's not new news:

He said: "a true producer can flip a sample". DJ Premier can flip a sample. He might not need to all of the time because he has $ to clear samples and whatnot, but if someone can't afford to do that, I suggest they learn how to make samples unrecognizable or get obscure records.

They have firms of people who look for samples hidden or "flipped" in people's music....

I believe the "7" you guys are thinking of is the 7 year patent? possibly it might have something to do with certain patents becomming public domain after 7 years... I am not sure.

When I first saw the title of this thread, I didn't think it was gonna be about legal stuff but rather about breaking codes... for example how that jenny from the block track did..

its not really necessary to worry about this stuff till you start becoming a household name.

for now i would go with the advice that has been brought. sell it and tell the artist that if he wishes the samples be clear, its his problem.

if some label becomes aware the most they will do is tell you to stop using the track. if its a big hit then yes they will seek compensation. if thats the case and you dont wanna pay, you can still release the track (even though the label will say not to) on the down low which might not get you money but will certainly get you more listeners and the label wont be able to do nothing because your not actually making money off of it and its not on an official release.

There are HUNDREDS of cases to be processed for exactly this kind of thing. Intellectual property violation only makes news if your name is already newsworthy. The hundreds of guys being charged with cease and desist types of things are no more famous for it really... can you think of any?

it's true though, no one is going to stop you from passing out CDs to friends n stuff like this, but when it comes to selling beats, or having larger runs pressed, copyright laws start becoming more meaninful. Imagine dropping a few grand to have your first album pressed, cover art printed, etc., and then being busted for stealing some $h!t and having to hand over all your copies to be destroyed.

Alternatively, if you are able to do it... produce everything from the ground up without needing to sample. No one is going to be suing you then!

sample from wherever u find something dope be it tv, radio, vinyl, records, mp3s buy the time u have choped and made ur beat no one will hear it and say that sound like a utube sample.

I could be wrong but I think Stones Throw only has (usually) one pressing/release of records so that when the Cease and Desist letters come they're already cool.
But yeah...just **** sample and if you get good enough at it to worry about clearance, consider it a blessing.

nah sample it direct on some madlib mf doom shit it dont matter u cant tell the difference that much, long as the sample gets flipped good and shit has some dope drums and bass shit will rock well
